00:00:09,630 All this month’s uh Burleigh County planning and zoning meeting to order. Uh, we’ll start with a roll call. So Marla, if you could take us through that. Comm Bitner Comm Connelly. Here. Comm Jarrett. Here. Mr. Munsen? Here. Comm Patrick? Yeah. Comm Richch. Here. Comm Streifel here. Comm Zuroff. You. And Chair. Here. 00:00:37,470 We have a quorum. Fantastic. Uh, we’ll move into the approval of the November 12, 2025, uh, meeting minutes. Are there any corrections that are needed? I move to approve is presented. Second, Aet has been moved to approve, uh, as presented, and seconded, all in favor say aye. 00:01:02,530 Any opposition? Hearing none Minutes are approved We’ll move into the public comment portion of the meeting. So if there is anyone here that would like to, uh, give us some public comment. Uh, please step forward to the lectern and uh let us know what’s on your mind. 00:01:26,500 Anyone like to comment OK, seeing none, uh, we’ll close public comment. There is nothing on our consent agenda, but we do have 3 public hearings tonight. So our first public hearing that we will move into is for the Hughes subdivision and, uh, this was, uh, this was uh Continuous. Continued. Thank you. 00:01:44,230 Uh, continued from last meeting and, uh, Mitch, is there anything you, uh, would like to add before we, uh, get into this, uh, this public hearing. Well sure, Comm, Mr. Chair. thank you for all showing up on a cold night. It’s 11 degrees out there, you know, so, um. yeah, the, uh it’s a continuation of the November 10th meeting. 00:02:07,630 Uh, the, I’ll start with the legal description, lot 2, block 3 in Country View estates. Auditors, lots and and O all in section 3 of the township 138 range 79. Uh, it’s in Apple Creek Township. This is, uh, uh, basically a very simple lot combination, 3 lots they’re trying to combine into a 13.10 acre sized lot. 00:02:33,270 uh, paying waiver is not required because it’s on a, a cul-de-sac. Apple Creek uh Apple Creek Township has recommended approval. We received an email from uh Dan Reece today, says, I am in full support of the Hughes subdivision platform. So that’s very important because they have zoning jurisdiction in that township. 00:02:56,800 We have planning authority, but we, we depend heavily on their recommendations of whether to approved or not approve. Um Stto manage management plan was applied for and I believe it was approved. Um 6 revisions, uh, have, uh, come to us on this flat to, to reach ordinance, uh, Article 33. 00:03:19,730 What is that, uh, discussion here is whether or not basically we can pull an existing lot out of an existing subdivision and create a new subdivision of that. Century Code, in my opinion, says we can, uh, as long as it’s all owned by privately owned, um, and all these lots are owned by the people who live there. 00:03:43,730 And the owner, the applicant did ask for a petition from all the homeowners there, and I believe that might be in your packet. um, and I believe it’s all the owners. I couldn’t get to. OK. It’s close It’s close Yeah, so, yeah, I think there’s 13 owners in there, but, uh. 00:04:13,170 it’s um there’s a majority of people who are in are OK with what, what the applicant wants to do. And so, at issue is whether we can follow through on Sentry code Title 40. on allowing this, which is it happens all the time. 00:04:38,800 If it’s privately owned and it’s um and they there was discussion of a master plan in the area from uh the people uh from Mr. Mariner who owns the property to the north. Um, we have looked into that and we, we do have a copy of it. 00:04:59,070 Did you give a copy? Um, but we’re trying to find whether that was approved or not by a governing body which would have probably either been Apple Creek Township or City of Bismarck. This original Platte Country View estates was approved by both the city and the county. 00:05:18,270 and there were some discussions at that meeting, uh, at that commission meeting of whether who should be doing the approval of this of the recommendation of it was Apple Creek Township, who was not involved this time, so. uh, the only sticking point of discussion is the um whether or not we can recommend approving, uh, vacating the existing plot and creating this new one. We have not received an opinion from our state’s attorney. So, um I don’t have any other thing to add. It’s pretty much the same. 00:05:44,100 You guys are familiar with it. You had it was in your packet last month and you have it in the same thing this month would be my recommendation to table it for one month and hopefully she’ll have time. but that’s only my record you can guys can decide what you want to do, so. 00:05:59,430 OK, they are still actively working on it, on their request. We have no response, so I, I’m open for any questions. Haven’t said no yet. Good. All right. Uh, yes, commissioners are off. Chair, uh, Mitch. 00:06:20,730 So, have mariners change their tune on this at all, or have you, uh, I mean, cause I’m, I don’t see anybody from their group here tonight, so I’m assuming it’s Be behind uh, column there, yep. OK. So, yeah, I, we haven’t heard. I, uh, um. we haven’t heard anything back from them. Because. They may say something tonight. I don’t know. The, the other thing for consideration looking at this, obviously the intent for Lakeview Drive. 00:06:45,870 when I’m assuming when, whether it’s a year, 5 years, 20 years down the road, um, Mariners go to actually develop that, um uh, that Hughes here will essentially own. 00:07:06,800 you know, a significant stretch of land along what would be, I’m assuming proposed Lakeview Drive extension looking at how their lot is shaped and my understanding of that is the have the potential of coming to the Hughes’ requesting half the cost of the construction of that length of road when that development goes in. That’s accurate. Mr. Mr. 00:07:30,100 Chair, they, they, he would have to sign a paving waiver on approval of this lat which at the time of the development of the road, he would, the owner of the whoever owns that property would be responsible for half of it. Right. On just on his frontage, so. OK. He, he doesn’t have to pave it now, but it someday it will happen someday. Yeah. 00:07:49,370 All right. Well, thank you, Mitch. Uh, if there’s no other questions for Mitch, we can, uh, move back into the public hearing. Uh, this is the public hearing on the Hughes subdivision. So if anyone, uh, would like to speak at this hearing, please approach the lectern. Tell us who you are, where are you from, and sign in. 00:08:05,430 If anyone would like to speak in this public hearing, as the second call for public comment. and last call for any public comment if anyone would like to speak in the, in the hearing. uh, of the, uh, Hughes subdivision. 00:08:38,600 seeing none, uh, I guess, uh, I know there was a, before we close this hearing, uh, I know there was a suggestion to potentially uh continue this hearing until next month’s, uh, next month’s meeting. Uh, so I don’t necessarily want to close the, uh, the hearing. So, uh, yeah, any comment on that, uh, Comm Connelly. 00:09:03,530 M Mitch, if we did say approve it or move it on to the county commission. Would that allow enough time for the state’s attorney to respond. Mr. Chair, uh, Comm Conley, I I can’t tell you what she would do or not what, what would happen in between now and then. I, um I would recommend to wait until we receive that. Um and it it’s, we may not receive an opinion. 00:09:29,700 I mean, the ensoda and that, as far as I’m concerned in that is there’s many parts of it that are vague but this to me is pretty simple. It’s cut and dry. We, we do these all the time and it’s you know, it’s not uncommon to combine lots out of an existing subdivision. 00:09:46,800 And yes sir, yeah, I mean, kind of goes along the same lines of, I mean, we could recommend approval contingent on, uh, uh, with, with, with a condition that, uh, this, you know, it gets cleared by the state’s attorney prior to the county commission hearing again. Correct. OK. 00:10:07,630 Because, I mean these folks are coming to meeting after meeting. Right. And it just put, it takes one of those out of there. So. Yeah, it doesn’t have to necessarily be in the states attorney. It could be somebody we hire. Yeah, cause I mean, really, this, I mean Mitch is right, this happens all the time with you know, existing plotted lots getting replatted Mhm. 00:10:38,100 in the new subdivisions all the time. All right, any other questions for Mitch before we close the public hearing or excuse me, before we, uh, uh, either close or continue the public hearing, uh, Mr. Patrick, did you have something? Well, I, I think, I agree. I think what we should do is we should approve it. 00:10:54,000 contingent upon hearing from the uh state’s attorney and forward it on to the County Commission. So I’d like to make that motion. So. So, is there, um, uh, I, I’m, we will, we haven’t closed the hearing yet, so you can’t make a motion. 00:11:13,430 Uh, is there anyone that, uh, has any need to feels any need to continue this hearing. OK, seeing none, we will close the public hearing and move into discussion and action. motion. All right, it has been, uh, moved, uh, by Comm Patrick as seconded by Comm Rich to approve this pending the. What happens if we can. 00:11:37,870 The, uh, I guess, how would you, how would you word it? Approval by the, uh, safe attorney. OK. Pending the approval by the state’s attorney. Or opinion, excuse me, Mr. Mr. Chair. Uh, yes, I can’t guarantee you we’re going to get an opinion from the state’s attorney. I don’t, I, I’m, I hope so. 00:11:53,900 I hope that she can do it, but, you know, she’s very busy and it’s maybe just a legal opinion that’s from a uh a retained attorney from the city from the Burleigh County uh, not necessarily has to be the state’s attorney. just legal opinion Would you, uh, like to change your motion to not necessarily call it state’s attorney. 00:12:16,270 We may not receive that is what I’m saying. And so, are, are you saying that if we were to do that, take that portion off the, the county Comm then could go ahead and approve or not approve, uh With the state’s attorneys. Mr. 00:12:32,800 Chair, no, the, my, my recommendation to your motion is to have a legal opinion that uh two Burleigh County Commission on whether or not this would be appropriate to approve this. County Commission received Legal opinion. OK. And you were fine with that as a as a seconder I guess so. 00:12:53,630 I’d just soon just approve it as it is and move it to the city commission. I don’t know about the legal opinion, just blow it off. We haven’t had it. Well, it’s been, it’s precedent. So, we’ve got, uh, a motion with the, uh. 00:13:10,730 Pending a legal, legal opinion Uh, are you OK with seconding that? No. OK. Is there anyone with, like, a second, uh, the motion that is, uh, moving for approval with a legal opinion or pending a legal opinion to the county commission. I’ll just remove we remove the legal opinion, just to prove. Sure. Right and forward to the Comm. I’ll second that. OK. 00:13:30,970 So, your motion is move to approve uh, recommendation to approve at the county Commission, correct? Right, that’s, I just want to make sure that we’re clear and there is a second, so it is, uh, it has been moved for, uh, recommendation for approval to the county commission by Comm Patrick, seconded by Comm Rich. 00:13:58,230 Uh, is there any discussion on the motion? OK, seeing none, we’ll move into a roll call vote. So Marla, if you could take us through that. OK, yes vote means that you approve the motion. Um, Comm Connelly? Yes. Comm Zuroff? Yes. Comm Streifel? Yes. Comm Jarrett? Yes. Comm Munsen? Yes. Comm Patrick? Yes. Comm Richch? Yes. and Chair. 00:14:28,630 Yes He approved OK. Uh, that the Hughes subdivision will move to the Burleigh County Commission with a due pass recommendation. We’ll move into our next public hearing for the evening, and that is the public hearing on the Koontz subdivision and it looks like Marla will be able to take us through a few 00:14:44,870 details on that, uh, before we open up the public hearing. OK This is the K K subdivision. Uh, they were requesting approval of the final plat and a do pass recommendation, um, the location is 1951, 149th Avenue and West, Northwest, described as Burnt Creek Township, Section 7, Lot A of the northeast corner, beginning at 00:15:19,070 the northwest corner through east 100 or 1320 ft south 1320 ft west, 1320 ft and north to the point of the beginning Um, it’s 40 acres. um, there was notifications were sent to the Bismarck Tribune, uh, November 29th and December 6th, Burling County website, November 29th and surrounding property owners, November 26th. 00:15:52,000 Um, just, uh, was the subdivision, um, Albert and Linda Koontz approached us to put an accessory dwelling unit on their 40 acre lot and um, there are already two main buildings on the property, uh, manufactured home and uh 11,000 square foot accessory building built in 2008. 00:16:15,500 Um, the maximum allowed square footage of the AD ADU is limited to 1500 square feet. Um, when they turned in their plans for the proposed building, the accessory dwelling unit. 00:16:43,270 It was 2580 square feet, which was too big, so we advised them to go ahead, cancel the special use permit and apply for, uh, subdivision platforms, so they decided to divide it into a two lot subdivision, one containing just over 10 acres and the other is the remaining, I think it’s like 29 acres. So, um, the applicant has fulfilled all the requirements for Article 33 subdivision Regulations. 00:17:08,370 The applicant has fulfilled the requirements of Article 11, agricultural zoning, which it is plotted now or which it is now, um, the stormwater management plan We has been approved, and, um, the subdivision has been reviewed by all reviewing entities and the minor changes and corrections have been made and submitted. 00:17:30,270 Um, the subdivision meets all the requirements of the Burleigh County Comprehensive Plan, Article 3 residential Neighborhoods Objectives 1 and 2. And um they’re requesting final plot approval, and I do pass recommendation and staff recommends they do pass recommendation and final approval. Any questions for Marla before she steps away and we open the public hearing. Seeing none, thank you, Marla. 00:17:57,500 We will now open the public hearing on the Kuntz subdivision, and this is for the special use permit. and final pla Marla is this. Yep. It’s a spinal plaque and a due pass recommendation. Not special use? Nope. Special news. Um, we canceled that OK. In October. Got you. This is just for the final flat. Just want to be clear for the final plaque. 00:18:20,470 It’s what we recommended after we saw the size of the accessory dwelling unit. It would basically be two full-time, full-time residences on one lot, so personal. Thank you for the clarification. 00:18:38,700 OK, we’ll open the public hearing if anyone would like to speak at this public hearing concerning the Koontz subdivision. Please approach the lector and tell us who you are, where you’re from, and sign in. Anyone like to speak at this public hearing regarding the Kuntz subdivision. and the final call for anyone that would like to speak at the, uh, this public hearing with about the Kuntz subdivision. 00:19:00,370 Seeing none, does anyone, uh, have any reason that we need to continue this public hearing? OK, we will close the public hearing and move into discussion and action on this public hearing. Move to approve as presented. Second. OK, Comm Connelly has moved approval or a due or approval to the county Commission for the Kont subdivision. 00:19:24,630 It was seconded by Comm Zuroff. Is there any discussion on the motion Seeing none, we’ll move into a roll call vote. So Marla, if you could take us through that. Hey, um Comm Zuroff? Yes. Comm Streifel? Yes. Comm Rich? Yes. Comm Connelly? Yes. Comm Jarrett. Comm Munsen. Yes. Comm Patrick? Yes. And Chair? Yes. 8 OK. 00:19:58,630 The Kuntz subdivision is passed with the approval or recommendation for approval to the counting Commission. Moving to our last public hearing for the evening, the spring coolee subdivision Short plat and Marla’ll take us through some details on that, and then we can open the public hearing. OK. This is a spring coolie subdivision Replat. 00:20:21,530 um, and they’re requesting final approval of the plat and a due pass recommendation. Um, the engineer is Swensson Hagen and Company, and the location is 1561241st Street Northwest, and it’s described as block 1 and 2 of spring cooly subdivision block 1 lots 1 and 2. Um the partial size is 15 acres and it’s own rural residential. 00:20:53,100 notifications were sent to the Bismarck Tribune, November 29th, December 6th, uh, Colony website was November 29th and surrounding properties, November 26th. Um, the history is the petitioner applied for a building permit to construct a 2600 square foot building, um, to be used for storage and a workplace. 00:21:18,700 The lot just was described as lot 2, block 1 of Sring coolly subdivision is where he intends it, because it is a separate lot, it doesn’t compel contain a principal residential structure. So though he say joining a lot, we advised him to combine the two lot s into one, into a one lot subdivision. 00:21:40,000 The spring coolly subdivision was planted and recorded in October of 2017, and the zoning change was also recorded in 2017. The application has fulfilled all the requirements of Article 33, um, subdivision regulations, um, the applicant has fulfilled the requirements for Article 12 Ru Single Family residential, a stormwater management plan was not required. 00:22:11,700 A paving waiver is not required, and the subdivision has been reviewed by all reviewing entities and the minor crutcheon, which was to change it from spring coolly 2nd subdivision to Spring Coe Replat, um, has been corrected. and it meets all the requirements of the Burleigh County Comprehensive Plan, Article 3 residential Neighborhoods Objectives 1 and 2. 00:22:37,700 Um, staff recommends approval of the final plot, and I do pass recommendation to the board of County Commissioners. OK, any questions for Marla? Seeing none, thank you, Marla. Uh, we’ll open the, uh, public hearing for the Spring Coy subdivision Short plaque. 00:23:01,170 If anyone would like to speak at this public hearing, please approach the lectern. Let us know who you are, where you’re from, and sign in. Anyone like to speak in this public hearing. and last call for the public hearing regarding the Spring Coy subdivision short plat. seeing none any reason we need to continue this. OK. 00:23:23,700 We will close the public hearing, move into discussion and action. Yes, Comm Richch we approved the Replat and give a due pass recommendations of the board of Burleigh County Commissioners. OK. It has been moved by Comm Richsch to uh to approve, uh, move for approval and uh move this to a due pass recommendation to the Comm, the county Commission, and it was seconded by Comm Patrick. 00:23:46,000 Any discussion on the motion Seeing none, we’ll move into a roll call vote. So Marla, please take us through that. Comm Munsen. Yes. Comm Jarrett? Yes. Comm Connelly? Yes. Comm Patrick? Yes. Comm Rich? Yes. Comm Streifel. Yes. Comm Zuroff? Yes. And Chair? Yes. All approved OK. 00:24:15,370 That has passed and we’ll move to the County Commission for, uh, approval. in other business, we have an amendment to uh to talk about the amendment to Article 21, uh, floodplain District regulations and uh Mitch, you can take us through some of the details of, uh, why we need to consider this, Mister Cherere, Comm, uh, 00:24:35,900 this is, uh, kind of a mandate from the state of North Dakota that we include this on our ordinance, the basically its preamble of this ordinance, um they came up with this as part of that, uh, SB 2027. 00:25:06,100 The Senate bill, uh um, asking townships to either do their own flood plain ordinance management or um delegate the Bismarck County. It’s just basically that underlying section at the very beginning. uh, anything else, uh, was this one page. 00:25:31,730 is not changing anything in, in um Article 21 We may be you know, it depends on the township, what, what they plan to do, but we may be doing their floodplain management for most of the townships in the county. uh, just a question when it says, uh, floodplain, where does that map or what what calls out or what makes a floodplain district. Where does that map come from Um I think the flood, the reference to flood plain district is in the Ordinance, uh, Article 21. 00:25:55,800 or uh yeah, Casey, if you could maybe enlighten us on where that comes from So, the fund process of the flood plain, uh, we do it about every 10 years. It’s through FEMA. 00:26:16,730 It generally starts about 2 years in advance of that, and we actually model the Missouri River, Apple Creek, all, all these different areas we look at and we discuss many areas such as Burt Creek and Hay Creek. We extended some of the limits going north up by 26, and we look at how the flood plain and floodway are affected. Uh, once all those models are done, we have a lot of public hearings. 00:26:32,530 People have their right to give input, and be able to go through FEMA then goes through and checks everything. Uh, also goes back for public input. 00:26:47,800 At that point, it’s more this is what the floodplain’s going to be if you disagree with it, uh, resident can hire an engineer to say this is why I should be out and give different reasons through there and there there’s some valid reasons that do happen on that, but once that’s approved, then that floodplain’s enacted, then Mitch gets the fun job of enforcing it everyday. 00:27:03,600 So the, so the map, if, if say the town ship s are looking for, oh, well, what’s, what’s a floodplain in our township? They just come to the county or come to you or Mitch or when it comes to that FEMA part, you, we, I can send a message out to the townships that they want that generally we look at areas that are being developed more because you do fall into a 00:27:22,370 whole lot of rules really quick when it’s an identified floodplain and flood way versus they call it Xonac on the maps of it’s just unknown at that time, so you can get a lot of restri ction s put on you really fast, so we’ve tried to be really careful at which areas we 00:27:36,730 actually look at. Doing that it’s more when we know houses are gonna be there versus, uh, fields and uh farm, ranch, ranch land. Yeah, so there’s not, there’s not necessarily a, a countywide map that is, that is set saying this is floodplain and this is not, or is there? It is. 00:27:57,530 We just, it’s how intensive do we wanna look at it vers on there because it’s you can, once floodplains there, it’s not going away. uh, so that’s we try to be judicious. when we look at it. Thank you. 00:28:23,630 We have a meeting next week at the library Weyu Township can be show up and it’s basically uh probably 60% of 70% of Burleigh County is, is, is has been mapped. Um, we don’t, uh, some of the other the other unpopulated areas has not been mapped, but we do rely on Andy RAM for that. portion of this that they have identified wetlands and and uh. 00:28:47,170 riverines and that sort of thing and that’s kind of the precursor. but um it’s, yeah, it’s basically identifying these areas. The ideas on the IndyR RAM is it gives you an idea, yeah, this is, this is identified as a flood plain or a a wetland and um so subject to flooding. 00:29:09,530 um, and most likely it will be mapped as a flooded area on the FEMA maps. We don’t know that because we’re not FEMA, but it, it does help in making decisions when you issue building permits out there. The townships are not doing any favors to these people. 00:29:24,530 They issue a building permit in a floodplain or a known flooded areas. that are that are apt to this because it’s once they’re they build their house in there. it’s, they will pay insurance, high rates, if it’s in a floodway. they can’t do any work to it. 00:29:43,100 It’s, it’s kind of con not condemning, I don’t wanna say that, but it is you know, you’re not doing any favors by issuing a permit letter and build in those areas. 00:29:59,700 We say NDRAM, what is the, what’s the It’s a map that they have that they created, um, that’s, I can’t tell you exactly what it is, but if you, if you Google Andy RAM, you can get to the state and you can see it and it does show it’s, it has a uh you know, interactive map that you can move and locate where you live or where you wanna look at it to identify it as one of these uh areas. 00:30:17,330 Got you. I’m just, uh, just curious on uh on where these where these, you know, cause obviously in the at the township level, they don’t have the staff that is, that is going to be going researching this and stuff like that. 00:30:33,270 So I’m just asking the questions to make sure that, uh, there’s easy access to things to make decisions. DWR, North Dakota Department of Water Resources on their website. and it’s so there’s some, some parts with the wetlands on that, that’s just what they identified by what they call an office review. They’re just looking the top down. It’s not an on the ground. 00:30:55,870 They’ve actually looked at it and identified cause water is a bad indicator of a wetland. It’s actually, it takes 3 components. It soils, the right type of, uh, it’s not grasses, but plant material and renewable water source. 00:31:16,270 So that, like when we get into projects, we actually hire a wellA delineator to go out there and get the actual limits because sometimes what you see on those maps that says, oh, it’s all this over here and it’s not, and then we find out, hey, we have all new ones, so it, it, when we do project into those you get more in depth 00:31:31,070 into those so it’s, gives you a good idea on those things. Well, good to know. Good to know KC. OK, is there, yes, yeah, a lot of, there was a lot of review when it came to the FEMA flood maps, um, that were adopted, revised because of technology increases, and that 00:31:50,430 formerly was passed, uh, or we had to accept it June 6th of the last year, correct? Yes, that, that’s correct. That was the last one. That’s where we resolved the Apple Creek in Missouri River models because Apple Creek. 00:32:07,070 model and Missouri River at one point, they said the water was 7 ft higher in Apple Creek than Missouri River, and we all know that’s not true. So, it was getting all that resolved out. Well, it’s a big deal at the city because there’s a huge product project impending, and it’s hundreds of millions of dollars. 00:32:23,370 Yeah, yeah, I, I know when we’re reviewing it, we’re like this is going to be uh, an interesting one moving forward. It’s gonna cost a lot and part of the floodway had a breakout area in Apple Creek that instead of that in Apple Creek it all of a sudden was going through where existing houses were at and where this is. 00:32:38,900 this is gonna get a lot of uh feedback and in Bismarck itself, the a lot of the affected areas are people with lower incomes that can’t really afford tacking on a flood insurance bill, so. 00:32:55,430 yeah, and that’s a lot of what we looked at and we’re, we knew going forward that was going to be discussed a lot at both county and city commissions on there, appreciate it. All right. Any, uh, any further questions for Mitch at all? Moved to approve the ordinance. Well, we’re going to, it’ll be back. We have to read this. 00:33:13,000 We have to get this read. So this is the first reading and then it’ll be back the next, the next month in January for action. So we don’t. OK. Yeah, there’s no, no action needed to. OK. OK. Well, thank you much. Yes, yeah, go ahead. This is just a procedure, right? We don’t have any options. 00:33:29,530 No, this is kind of a, like an order from the I don’t really have any input, really.
