Not hearing any, uh, is there a motion to cease nominations and cast unanimous ballot for James Landenberger for the Chair. moved Second, OK, we have a motion by M Manger Smith. 00:01:30,630 second by manager Mitchell. to uh nominate uh James Landenberger for Chair. All those in favor of James Landenberger for Chair, please signify by saying aye. All right. No I have it said Jim, I and myself as elected Chair. Thank you, grateful. 00:01:57,370 Um we will now move on to the election of the two remaining board officers this morning, starting with the vice Chair. I will open the floor for nominations for vice Chair. I would like to nominate Roger Smith. OK. Is Roger Smith consent to the nomination? I do. OK, Roger Smith has been nominated for vice Chair. Are there any other further nominations? Any other further nominations for vice Chair. 00:02:20,870 One last time, any further nominations? Not hearing any, is there a motion to cease nominations and cast unanimous ballot for Roger Smith for vice Chair. I, I, uh, go ahead, Dennis. OK. Motion by Dennis, Manage Reep. 2 Second by Manager Mitchell. to cast unanimous ballot for Roger Smith for vice Chair. 00:02:45,100 All those in favor of Roger for Vice Chair, please signify by saying aye. right right pose I have it and Roger is elected vice Chair. Gratz Roger He will now move on to Secretary Treasurer. I’ll open the floor for nominations for Secretary of Treasury for 2026. I would like to nominate Dennis Reapep. OK Man Reep, do you consent to the nomination? for Secretary of Treasurer? Kate. 00:03:14,100 Are there any other further nominations? Any other further nominations for Secretary-Treasurer? One last time, any further nominations? Not hearing any, is there a motion to cease nominations and cast unanimous ballot for manager Reap for secretary-treasurer for 2026. and a motion by Manager Smith. 2nd, 2nd by Man Mitchell. 00:03:39,500 to nominate you know, manager Reap for secretary treasurer. All those in favor of Man Reap for Secretary of Treasurer, please signify by saying aye. Aye. A No, oppose The eyes have it and manager Reep is elected Secretary Treasurer for 2026. That will cease our elections for the, the 3 board officers for 2026. 00:04:08,100 We can now move on to the next item on the agenda this morning. Uh, review and approval of the 2026 member portfolio. So, um, as you know, at this meeting we kind of we usually walk through those portfolios and assign um means we still have one more manager to add to the board, which will probably be at next meeting. 00:04:25,270 I think at this point we will probably table this conversation until next month’s meeting. So in the interim, please read through that listing of of, uh, portfolios and just make sure if there’s ones listed that you’re still interested in in having, uh, we can certainly have that conversation next 00:04:40,800 month and then get, uh, the remaining ones that were assigned to Manger Jones assigned to uh, the new board member, so. OK? Any questions on that Kate. All right, we can move on to item 3 this morning, the reappointment of our admin administrative secretary or engineer in our legal counsel. 00:05:03,170 So we have received uh, 3, updated, uh, 2026 proposals from these uh three or those three. So you guys had a chance to review those and any questions or thoughts this morning? OK? If not, we’ll need a motion probably for all three. 00:05:25,630 I, uh, moved that we reappoint, uh, all three secretary, engineer, and legal counsel to their respective physicians. OK, for 2026. For 2026. OK. We got a motion by Man Smith. The second by manager Mitchell to reappoint our administrative secretary, our engineer, and our legal counsel for 2026. We do you take roll call vote, please? Initial Yes Manager Re Yes. Manager Smith. Yes Chair Landenberger. 00:05:59,100 Yes motion passes. They are reappointed for 2026. OK, uh, moving on to item 4 this morning. Approval of last month’s meeting minutes and may get a chance to review those and any changes or. additions Moved to approve OK. OK. Got to motion my manager Smith in the 2nd ba. Manager Mitchell to approve last month’s meeting minutes. 00:06:24,330 All those in favor say aye. Aye. I. pose The eyes have it, mince our fruit. Move it on to the agenda this morning. Any changes to the agenda. Not hearing any? Is there a motion to approve? Motion to approve that second. OK, I got a motion by Man Reep. 00:06:49,900 The second by Man Smith to approve the agenda as presented. All those in favor say aye Aye oppose Aye, sabot. Agenda is approved. Item 6 comments from members of the public not associated with the project, but still under business with the Burley County Water Resource District. Not seeing any this morning. We can move on to McDowell Dam. 00:07:15,000 Check any updates on your end? Yeah, as far as the, uh, leases go, uh, we do have, we have just signed the leases and they will be sent out for the agricultural, uh, lease with Mr. Brown and also the uh Aero Club lease with, uh, Mr. 00:07:34,270 Heskin, and I believe, uh, Attorney Bliss has been speaking with, um, uh, Major Coburn regarding the Civil Air Patrol, uh, lease and are there any updates? Uh, yes, Mister Chair and Chuck, um, there are 3 different individuals with civil air patrol now. 00:07:56,630 Um, I would like to get some clarification with regard to their position on the indemnity clause, which we presented um, uh, to make sure we understand whether they object. One did, I believe one didn’t. 00:08:16,900 So I, I can report back to the board, uh, on that with revised contract, uh, approved by the Civil Air Patrol and then the board can um make its decision at that point So the other two have already been approved and signed. Correct. Yeah. OK. They have, And remind me again, what, what were the, the terms on those as far as the years? 10 years. 1010. So all three are going to be 10 years? OK, wow. OK. Yeah, the board had suggested that, I believe, at the last meeting. 00:08:34,530 To make sure civil air patrol was 10 as well as Aero Club, and that, that’s what Civil Air Patrollease says now. OK. Uh, curious Dave and Dave, anything that you’ve seen out there with, you know, C civil air patrol. I, I don’t know if they’ve even were even out there last year. 00:08:48,870 And then how about the Aero Club? Be, things have been pretty good? Pretty. OK. Yeah. OK. Good. Thank you. OK, so next month we’ll work through the Civil Air Patrol one and finalize that one, OK? Anything else, truck on any of your items? Nope. I think that covers it. OK. 00:09:10,270 Uh, I don’t know, Michael, anything you want Travis update on the. Oh, how do we do this? Which order Weinstein? Um, we’ll step through a couple things as far as the easement side, obviously Mr. Anderson still hasn’t commented back, you’ve been in touch with him. That’s kind of an ongoing scenario we can talk about that a little bit later. 00:09:27,530 Um, as far as the Outdoor Heritage Fund grant, they denied it. um don’t quite know why. I’ve talked to a couple people, um, there was limited discussion actually to even put it on the table, so, uh, not quite sure what that was, but, um, what I put together from a discussion 00:09:47,100 of the uh project funding opportunities and next step is a short memorandum, uh, to give the board some opportunities to take a look at, uh, what’s out there or what direction you want to go, um, the DWR does not require a benefit cost ratio or an economic analysis for their funding. 00:10:07,430 They’ve already funded the pre-engineering on it, so I do not have a real concern about them not funding the actual construction. Um, so from that perspective, um, obviously you still got to go through the web grants process and put everything in there, um but related to a couple of things, obviously because the outdoor heritage Fund grant 00:10:27,630 monies are not available. Uh, the district has to come up with additional funds, and those additional funds are documented in the memo. Uh, you’ve already set aside, uh, significant amount of money to basically match the grant program dollars. Um, so the question is the availability of additional funds. 00:10:50,170 Uh, you do have some funds that you allocated in 2025, that could be utilized for that, and you’ve, uh, allocated additional funds in 2026 that, um, we’re dedicated towards some of the capital improvements, but that doesn’t mean you couldn’t use them for, for this particular aspect. 00:11:11,530 Um, an offset of that that’s been discussed as far as, you know, funding availability from your perspective is the, um, Burt Creek project has a, uh, reserve fund that was set aside for its original project that’s never been utilized So those funds are probably available. I think there’s $170,000 set out there. Um, I did prepare a memo. 00:11:31,900 um, back when relative to the maintenance of the project and so some of those funds could be transferred into this particular effort if you chose to. Um-hum. So just, you know, kind of looking back and saying what’s available. 00:11:47,270 The other one that I looked at in the discussion of the Outdoor Heritage Fund is what was missing in the application or what would they want to see? Um they have their directives, you know, A, B, C, and D, um I obviously put together the argument as to, you know, what A, B, and CD mean relative to the, the benefits that could be provided, um, you could dig into those if you wanted to reapply, uh, and go back to, um, 00:12:10,230 for one example that came to mind is that, uh, if the water levels down, the handicap ramp isn’t accessible. Well, you know, they support the installation of handicap ramps as far as their outdoor heritage fund projects, so, um, there’s a little bit of that. 00:12:30,800 The other issue is, is do you mesh the project, um, on the water supply with some other site improvements that are also eligible. Um, that’s a, that’s a conversation that, uh, we checked with Bismarck Park Re, got some ideas. It’s part of the capital improvement fund, uh, what’s eligible or what’s not. 00:12:47,100 So, looking at this, it’s kind of up to the board as far as how you want to, uh, consider repackaging, if you will. Uh, that application, uh, the recommendation is to talk to probably um several of the uh outdoor heritage fund members and say, you know, hey, you know, what, what didn’t, what didn’t you hear that you want to hear or 00:13:05,730 what more could we do to uh uh, I, I’ll use the term sweet in the pot a little bit and make it more fit there, uh, their guidelines. Yeah, I mean, during the presentation, we did have one you know, board member asked us that they were. unsure of what the overall benefit was and what. 00:13:25,530 how, how this really, you know, long term, uh, helps, helps the recreational area, you know, the, the, the dams so and the water quality, so I think we need to do a little bit more I think homework on how we present that. It, it’s very complicated. Yeah. 00:13:40,500 There’s a lot of people. You’re given a 10 minute window to try to explain, plus the application. but I just think some of that was lost a little bit. 00:13:54,330 We did have the one board member that that spoke very highly of, of the facility and how great it it has become in the and every time he goes out there, there’s, he sees a lot of people using the facility. So he sees the use and he sees probably why we’re considering it. I think what was lost a little bit was. what this project’s really, how’s it really gonna work and how’s it really going to benefit. 00:14:07,630 long term. And I think you’re, you’re right, when you have a 10 minute window it’s not allowed, you can say, and when you’re trying to educate or update them on the entire project as a whole, you know, you use engineering and and things we try to get through. Right. 00:14:20,530 U 6 to 8 minutes of that and you don’t have a whole lot of time. And then, um, I was surprised that there weren’t more questions Uh, one of the items that I did do from the standpoint of, uh, review thinking that, uh, DWR might need an economic analysis is I did touch base with NRCS, 00:14:37,630 uh, Erica up there. She’s a new state conservationist. They are willing to assist the board in updating the benefit cost ratio, uh, at the last time it was done, obviously a number of years ago based on the, on the short period of record was, it was 1.4 to 1. 00:14:53,530 So in that aspect, there’s a couple things that, that play into this. Um, when you think about updating that, I don’t know what it’s gonna be, might be 1.6, might be 1.2, but they are willing to update that and, and provide that data as assistance. 00:15:09,630 Uh, they’re looking at a few things from the, from the district to provide as well relative to the background that we did relative to the period of record and obviously, uh, going back to, um, the facility use and the number of visitors, users, that sort of thing. But they’d be willing to do that if this board would request it. 00:15:26,100 That benefit cost ratio goes in a number of ways. If you’re going before DWR, even though you don’t need it. it’s, it’s a, it’s a, it’s a checkmark, it’s a plus if, you know, from that perspective. 00:15:42,170 The other aspect of it is, is if you’re going to the county commission, looking for additional public funding, even though you may have it within your uh current portfolio, um, you would have that to support that. uh that request and, and to the public that you’re actually doing something that has a, a greater rate of return than your investment. 00:15:58,730 Um, that also goes back to the, you know, easement acquisitions and other, other items. So I guess, you know, bottom line, I’m looking at it, you know, direction from the board, would you like to go through and, uh, pursue that with NRCS and get that updated. Um, maybe that’s an ongoing discussion, uh, another thing to understand is your um. water permit goes through February of 28. 00:16:22,730 Now, typically on your. um. perfection of the water permit, you have to have something in place. uh, or in the case of this is if you’ve got something that’s actually in progress. In other words, you’re currently implementing, then that uh goes towards that perfecting the permit. 00:16:42,000 Uh, I do believe, and I don’t know that I saw it, James, was there a an email from the state relative to the water use? uh, for 2025. Yeah, there’s something in the packet today. That one was for because we need be filled. The annual water use The annual er. Yeah. 00:17:02,800 And we, with your, with your direction, like, uh, in fact, I came across last year, it’s going to be very similar, um, but we could update that and get that submitted. Obviously, there’s no use because there’s nothing built out there. So but that’s kind of where it’s at from our perspective. 00:17:20,430 Um, obviously, we think that, you know, board member like yourself or maybe Dennis, who’s familiar with that, to talk to a couple of the outdoor Heritage Fund members and say, um is there anything new that we could provide that would help the application and do you expend the dollars and resources to reapply, um, and go to, uh, get the NRCS update. 00:17:40,370 Roger, you’d mentioned that you knew one of the members really well. Uh Mr. Crowe. Mr. Randy’s on there? Randy? Oh, Randy Crowley. Crowe, I do know Randy. Randy was the one who was asked about the evaluation, so he was really the one that was digging in a little bit but, you know, more on the, on the benefit side. 00:17:54,530 So Michael, what did, what was our request for how much? Do you remember the dollar amountt Travis? There were 75% versus the DWRs at 45%. So it was a fairly, fairly sizable number. Yeah, it’s OK. 00:18:14,270 Was that part of maybe the issue, just the amount that we They never said anything. Or did we have a lot of, was there a lot of competition from from 50,000 to 5 million, so we weren’t exactly we weren’t the biggest project. OK. But there was, I think there was 18? 18 projects. I think there were 18 projects. Yeah. 00:18:31,170 All right. the sheer number of projects that they had to review values and judgment call on their base, you know. to kind of thin that out a little bit, but we just saw more value in some of the other projects. 00:18:48,070 When’s their next go around to? They haven’t set their next meeting date, but usually they’re. It’s twice a year, so. Twice a year. So, they did in December, the next, and the applications are probably due, what, at the end of October if I remember right, last year. Yeah. And they, they moved that around a little bit, so. 00:19:01,270 So, it could be March or April could be the application time frame. Right. Yeah. OK Yeah, and, and as far as, you know, I don’t know what are the wishes of the board, I guess, regarding NRCS. 00:19:17,730 I don’t know, Dennis, if you get any thoughts on that too, just, you know, you’re been a part of those in the past as well, but um, it probably makes some sense to me that we And we, we don’t have to do it for, uh, DWR funding. It’s just going to add a little more information to a potential future proposal to outdoor heritage fund. Right. 00:19:38,900 And like I said, you’ve got the outdoor Heritage Fund, plus you’ve got, um, there’s always been discussions what’s the value to the public, um, you’ve got that and if the, if the public does ask, you’ve got an updated number revised that says, hey, it’s got a net benefit and a positive return for the investment of this port. So. not unlike expanding the, the study range from 26 years to, to 58 or 56. So. 00:20:01,530 Dennis, he had something Yeah, it just maybe uh my perspective is that uh we’ve been to the Outdoor Heritage Fund twice now. um, I don’t know that I’ve ever felt, I wasn’t there either time, but I don’t know that the welcome mat was out in front of us, you know, for us to come in and 00:20:16,500 and uh look, you know, just kind of looking at the financial difference if I’m understanding it correctly you know it’s money. It’s, it is real money. 00:20:34,100 It’s not a ton of money that um it’s different if I’m understanding it correctly and that would come out of our own pocket I, I, I, I don’t, I, I definitely don’t think that we should. you know, moving forward with the project pending outdoor heritage fund because, um, you know we could be 4 or 5 months down the road before we get our next answer and. and, um, you know, financially my perspective. will be OK Mhm. 00:20:59,230 and so uh I don’t know that all the extra effort, you know, from this point forward is, is gonna produce anything beneficial to us that’s my, my big. So with that, Dennis, you’re thinking maybe not having the NRCS do that, the new BC evaluation. Yeah, I’m not, I don’t know if that would serve any purpose. 00:21:18,430 I mean, if they’re willing to do it, I mean it’s certainly a good piece of information. There’s nothing wrong with it, but I don’t know if it’ll provide any financial benefit to us. 00:21:31,330 I mean, the only avenue where it wood, I guess that’s kind of a question is with through the outdoor heritage fund and like I said, I don’t know that I my the feedback I’ve heard secondhand that we’re we’re moving the needle enough for them, so. 00:21:46,800 well maybe if we have, I don’t know Roger, if you’re willing to be to reach out to Randy and have that conversation and then, you know, we certainly Dennis or myself could also be involved or Michael or Travis, you know, if he had any specific questions for us, we can get a feel or a sense of what that might be and then if we feel maybe we have a good opportunity to reapply again this spring and maybe at that 00:22:03,000 point we could you know, take a look at having an NRCS. How, how long, what’s the timeline for that? Do you know? Well, that’s one of the things that they did not get from, uh, um, Erik. I will check back and see what their timeline is. OK. And the information. 00:22:16,630 They were looking for some extension of the um analysis that we did. I don’t know that that’s really necessary given the, the, the time constraints of, um, putting this together, but I will step back and, and check with her relative to the timeline and how quickly they can do it, what sort of 00:22:30,630 agreement they may need, um, or can they just, you know, proceed with it as that goes. Um, the other aspect of it is I think we should look from uh, Comm, Manager Reep’s perspective is that we should look at putting together the Web grants application. for DWR and move that process forward. 00:22:49,730 Remember from a cost share find um grant funding, we’re looking at DW or our Heritage Fund First and DWR second. They still can cross over even if we do it later. 00:23:06,870 So maybe the thing is now is the proceed and get the DWR funding in place and then if Outdoor Heritage fun, then the amount that’s used from either side might change a little bit, but, um, from a timeline perspective, um, obviously you’ve got the, the easement perspective, but you could purs ue the DWR funding at this time. They meet quarterly, um, so obviously we, um, did the preliminary design. Now we’d be going requesting money for final design. and the full project though. 00:23:27,170 Yeah, well, I think with the way they’ve got it set up, you go for final design and then you apply again for construction monies. Oh, you do? OK. So next, the next step then would be to apply for file and design. Right. OK. What’s the And the deadline for that is end of February for the next cycle. 00:23:42,630 I believe so, yes. OK. I think that’s a good idea, Mr. Chair, I think that would be a proper. Yep, that makes sense. Consensus, OK, OK. Yeah. Good with that? OK. All right, let’s move forward with that and maybe we’ll hold on the NRCS. 00:24:01,330 Yeah, I’ll, I’ll check in on status and then get back to you on it. And then I, I know, Roger, if you’re comfortable reaching out to Randy and to see him. I’ll, uh I’ll see how much you can share and uh and find out, you know, yeah, maybe after we get security DNR funding, maybe we have a less our request for funds is less maybe that’s 00:24:23,730 they have a little bit more appetite and, uh, Yeah. And see themselves as kind of a partner in the project rather funding a big chunk of it, so. I’ll, I’ll see you, uh what, uh, Randy’s thoughts are and, and report back. OK. All right. Thank you, Roger. Anything else, uh, McDonald Dan this morning? OK. 00:24:46,700 Yes, yeah Or did Good morning. Uh, thought of a few things I wanted to give you an update on, uh, if you remember for the capital improvement plan for 2026, um. the couple of items that we had budgeted for for 2026 was the renovation of the shower house, the shower building. 00:25:10,730 Uh, little architectural improvement to meet those ADA requirements. Uh, we as the Park District, um, have gone through our consultant selection process and at our board meeting tomorrow night, we’ll be making a recommendation to our board to approve a contract with a, with an architectural consultant. And hope to move forward with that, um. couple of things on that. 00:25:31,600 We’re looking at still very preliminary, obviously we haven’t, uh, had a brief conversation with the consultant on this, but maybe opening up two windows of construction if we can, uh, possibly do it before the season starts. That would be great. 00:25:50,900 Uh, then we’d have it completed for the summer, but the other one would be waiting until after the season ends and, and going into the fall and doing the work. Uh, I don’t see it as a big project, um, should be doable. One thing we’ve done is that shower building has an old um uh forced air heating system and it hasn’t been run for a very long time. 00:26:08,000 We’re investigating what it would take to get it up and running. We’ve got a, we have a, uh, HVAC, uh, person looking at it to see if it would be feasible. um. 00:26:20,270 if we do offer it in the spring, the, the contractor may charge for heat or if we fix this thing up, it may be a it may be a wash, but then we have some a furnace that works if we need it in the future, so we’re kind of investigating that, seeing what that might, if that might be feasible. 00:26:35,700 Um, other thing on the the uh capital improvement this year was to purchase a new tractor. Uh, so in December we went out for um we awarded bids, um, budget was $120,000 of what we were looking at, uh, fortunately, we came in with something around $95,000. 00:26:55,730 So we did some, some kind of deep diving into what we really needed, what could we get, you know, what could we get uh, for, you know, best bang for our buck, um, so actually I was just right before I raised my hand there. I was talking with David about it, maybe. 00:27:11,470 maybe because there’s some additional money in there, I, I believe in 207, we had talked about setting a chunk of money aside for additional pieces of equipment for that tractor. 00:27:28,530 Maybe with that additional money, maybe we could that this year get one of those pieces this year instead of stretching that out if, if we can find a piece that we that needs that fits the dollar amount remaining. Yep. Um, so that might, that might be something we look at. OK. Um yeah, maybe, maybe revisit that, um CIP appointment with the budget’s order, then we can see. 00:27:45,730 if the price is right, you know, if, if we can find the piece of equipment that we need that fits the dollar amount remaining, and I think that might be a good thing to do if we can get it now. It might be a little bit less expensive, so. That’s good. It’s always good. Just wanted to share those couple of items with you. OK. All right. Thank you. 00:27:56,900 The ice fisherman this winter? Uh, a few. A few here and there? Yeah, I, I know my, uh, my youngest one out there with a buddy of his. They didn’t catch anything. OK. That’s ice fishing. Yeah. Yeah, that’s how it goes. That’s, yeah. Yeah. It’s good. OK. Thank you. Thank you. All right. And we can move on to financial reports this morning. Man Jereep. 00:28:20,230 and Mr. Chair board members on page 18 is the beginning of the balance seat. I will, um, go through the activity in December. Um, we did start, uh, with a balance and checking of $1,739,072.71. We paid bills. in the amount of $218,808.22. We had income in the amount of $34,180.83. 00:28:48,000 about 6000 of that was state aid, uh, about 1000 was real estate. The majority was, uh, insurance proceeds from the hailstorm mode of McDe Dam. So we, um, that came in this past month. uh, ending balance in our checking. savings account is $1,554,645.32. um, Rivera Wealth. um. is uh the current balance is 2,482,462. 00:29:20,070 61 cents that includes about $7600 in interest minus the management fees for that. um item of note with that is that the rate uh does continue to go down. It went down another 600 last. last, uh, 15 so it’s currently at 3.75% with the effective rate of 3.5. 00:29:40,800 and so I think that’s kind of on par with um, you know, fees, so I don’t know that I would recommend moving off where we are right now, but we can discuss if we need to. um. 00:29:54,970 er balance had a little bit of interest, so that basically maintains the same and then we have other current assets for a total of total current as of the $4,750,777.13. um. they go through all the activities of the month. Here’s an order. I’d move for approval of the balance sheet is presented Mr. Chair. OK. Thankspan. We have a motion to accept the balance sheet for this month. 00:30:17,630 Is there a second? Second. The motion by manager Jare seconded by Manager Smith to approve the balance sheet. When do you take roll call vote, please? Andrew Mitchell. Yes. Manager Yes. Manager Smith. Yes. Chair Landenbergerer. Yes, the motion passes. Profit and loss this Yeah, Mr. 00:30:41,370 Chair, um, I did go through the number. They all appear to be in order. One thing, you know, that kind of led into my discussion about uh McDonald Dam is the, uh, if you look on the, uh, on page, uh, which one is it? It’s the 21 page 21, the last row there 00:30:55,600 both our net net income from the year that’s, you know, that’s for all 2025. uh, 640,000 that’s been pretty standardized over the last few years so that kind of feeds into my my position that you know well it would be nice to get outdoor heritage funds. Um, I think we’ll be OK. 00:31:14,230 um, you know, managing it with it all in budget. as well, you know, our fund. So, um, I wanted forward to take up that with that, I’d move for approval of profit loss is presented OK I’ll second. And motion my manager Ja Reepen and seconded by Manager Smith to approve this month’s profit and loss statement. 00:31:32,470 When do you take Rocavo, please? Manager Mitchell. Yes. Manager Yes Manager Smith. Yes Chair Landenberger. Yes, motion passes. Profit and loss is accepted. Dennis, uh, there were two other another item on there under the financial reports. It’s just basically the additional information on closing out of that insurance claim out at McDonald Dam, so. 00:31:57,530 I don’t know if you saw that, yep OK, any questions on that OK. uh, and then I guess moving back to kind of Dennis’s earlier point, uh, I, I would probably tend to agree we’d probably just keep that in that account cause we’re probably not getting anything better as far as CD rates go, so. 00:32:16,170 There’s a consensus there. Yes. OK. All right. Anything else, Dennis No. OK We can move on to item 9 this morning, drainage permits and complaints. Uh, keelboat Park. Michael, I’m not sure if there’s any updates on that one this month. Yeah. Excuse me, Mr. Chair, no, yeah, no updates on that. 00:32:36,630 We still need to put together, I’ve got the documentation. I just have not submitted it to the state at this point. So, OK. And then, uh, the hacktree, I think there is a, maybe a slight update. Yeah, Hawtree, I called, uh, Casey’s coming up too. 00:32:52,230 Yeah, I talked to Brad Brown about the, you know, what was going on out there. And he was gonna do some checking as far as uh um, transfer of ownership and some of the other things. But Casey, maybe you’ve got additional update from. another side. Morning, Casey. 00:33:12,900 Morning, uh, late last week, I was given a call by uh apealmo Aler with independent land surveying and engineering. The HOA has decided to hire that firm to start working on everything to help resolve all of it. So they’re going to start working on the stormwater management plan Amendment, then they’re gonna work on roadway plans, culverts, how they’re all going to get done. They’ll submit plans to the highway department. 00:33:31,530 We’ll review everything, go through, make sure it actually meets the goals. They do need to obtain a drainage easement from the golf course that goes through the driving range and it sounds like that’s moving along positively and should be able to move forward. 00:33:49,100 Otherwise, at this point, we’re just waiting on them for, to get done and do their first submittal and go from there. OK. Thanks, Casey. Any questions for Casey? No, I appreciate the update, Casey. Like I said, I’ve been talking to Brad. 00:34:04,100 He was the actual, um, individual who filed a complaint and, um, it’s nice to hear that they’re progressing, Chuck and I talked about it too, as long as they’re progressing, we don’t need to do much more at this point. So. we’ll continue to hold. So reclose the. 00:34:24,900 Um or should we wait to see what happens on I, Casey’s review Um, I, the easiest might be, once we get everything submitted, I can just share it and uh send it over to Mike or Travis or Nick who whomever and they can take a peek at it too and any comments we’ll include him in our formal response letter that we give on comments, then be able to go forward from there. So the gentleman who filed the original complaint as he kind of is still involved in this whole process. 00:34:43,100 Well, as, as far as I understood, he’s involved in the process, but he hadn’t heard any updates. So, and he hadn’t really called and talked to anybody, probably was out of town or whatever. I think procedurally it’d be nice to see what’s actually being submitted and then based on that sub it’ll dismiss the complaint at that point in time. 00:34:58,000 Yep. Uh, but I will call Mr. Brown and update him on what you told me, Casey. And so that he’s, he probably knows who to call, but he just hasn’t talked to him yet. Yeah. 00:35:14,730 And Abe had a question on what size a storm needs to be done for the culverts, and we just told them North Dakota Stream Crossing Stans is to be followed, uh, has to be RCP culvert because it’s underneath the roadway, and then I’ll also coordinate with uh Hay Creek Township and we just let them know this is what’s going on, they generally let us just take the lead on on 00:35:32,730 those parts and any, uh, roadway improvements. OK. And I, I guess from a, again, from a procedural standpoint, the minute that they submit the plan would be the time that you could dismiss the complaint, because that’s the resolution. I think that, I think that works and I’ll let Mr. Brown know that that’s the process. 00:35:48,230 OK. OK. Yep. Sounds good. Thanks, Casey. You bet. Thank you. Thank you. Any other questions on that item OK, if not, we can move on to a new one that we have here with Gran or the update on Grand Prairie estates. Yeah, the, uh, gentleman at Grand Prairie Streets, um, basically came into our office. 00:36:06,900 He has filed it or will be filing floodplain development permit with the city. So basically that’s completely resolved or will be resolved at that point in time. OK. So, there was no formal complaint. 00:36:24,000 It was just a matter of floodplain violation and some of the things that he thought he had permission to do that he didn’t, and um that uh structure will not be restored or repaired. He’s not moving forward. He’s just going to basically restore the um the surface impacts that he created. And they’re all on his property, so quite honestly, level the ground seats and grass and they’d be done. OK. 00:36:40,730 So we can consider this one wasn’t a formal complaint. You can take it off the list for next month. OK. Thank you. Mr. Chair, I, uh, just one comment on Grand Prairie. Um, I’ve represented, uh, Midwest Dragline, which is owned by the Steiningers on unrelated matters. 00:37:02,870 So I’ve, um, participated, uh, with Mike uh toward the resolution of uh of this matter. OK. I do want to notify the court that, uh, that I have represented Midwest Draggline. OK, thank you. OK. Uh, no other drainage permits complaints. We can move on to projects this morning. 00:37:25,370 The Hogue Island, any updates there this morning? Um, realistically, we have not done anything with the, the easement revisions on Dave Chiers’s, uh, Braun was supposed to be going out and drilling. They got delays because of weather and stuff, so, uh, we’ll probably find out more. Uh, we’ve been monitoring Travis Minant there a couple times. Not a lot of major changes. 00:37:40,370 Um, it’s still fairly stable, um, the request letter went into DWR. DWR has been in the continuous mix of conversation, um so relative to that, um, you got a 50% cost share through them. 00:38:00,100 They’ve asked us, the district to actually proceed with um the investigation and the renovation, so we keep them in the loop on, on everything that’s going on. Uh, so as soon as the um, geological assessment is taken care of, then we’ll find out what might actually be done next year, next spring. OK. Uh, Roger Jones is another one. There’s a hard point to the north that has been eroding, um. 00:38:17,100 Have you been out there recently? Um, Travis was actually out there, um, the, some of the water levels have gone down. The backside of that hard point has been eroded. 00:38:36,330 The standpoint is, is there any significant new erosion or or relative to that, it probably isn’t, um, though we’ll, you know, monitor that going into spring. It may be one of those to its best to repair it before it fails. So there may be some work that’s, uh, necessary on that next spring or next year before. um, things go forward. OK. 00:38:52,370 I mean that would too would also be 50/50 but that we would go back to the state and we’ve identified that they’ve been out there, they’ve actually done drone flights. as to what’s there. What we have. OK. Yes. Um, one thing I would ask, this is kind of squirely off track, um I’ve got another issue with, uh, Verda. 00:39:09,870 relative to word is in process with Senator Kraemer’s office. Uh, wondering whether or not this board would want to at least recommend to Senator Kraemer’s office to put money in Section 33 for bank stabilization and maintenance. 00:39:30,800 It’s been on the list before, uh, hasn’t really gotten any traction, but I think it would be prudent given the uh impacts that are occurring out there that some money should be put into that account for, for maintenance purposes. Do you have any idea of what we’d recommend? Um, right now, word is not a an appropriations. It’s just an authorization. 00:39:46,870 So it would be the recommendation that the core consider putting money aside for Section 33 due to ongoing maintenance requirements. OK. Yeah. And if you’re OK with that, I, I’ll throw a, an email back out to uh Brady with, uh, Kramer’s office. Dennis, any thoughts, sir? Oh, sounds good I was asked OK I will do that. OK. Thank you. Thank you, sir. 00:40:09,170 OK. Any questions on Hog Island this morning? If not, we can move on to the Apple Creek. Posing the detail on the reimbursement is are able to send them invoices? They have to run it through their board. 00:40:33,800 What, what was the discussion there, Michael? Um, I think because it’s under the director’s limit that we probably could just submit, but I will have Travis check with, uh, Clay and, and see how they want to process that. OK, good question All right, uh, I don’t know, Roger, Michael, anything on the Apple Creek slide this morning. I’ll refer to Michael. Yeah, uh, a couple things on that. 00:40:55,630 We are looking at having kind of an internal meeting with DES on Friday. Uh, there’s been an ongoing monitoring of the various, uh, slope movements that are going out there, um, University of Mary’s grant through DES is closing. Well, actually it’s closed by December 31st. There’s some question about ongoing measurements. 00:41:19,630 um and so, yeah, we’ll have to discuss. Barra will be on the call as well, as far as their position and status, uh, Roger, I should get you included on that, uh, on that meeting invite. 00:41:37,900 So for the discussion, but yeah, I mean we’re gonna continue to monitor, and like I said, it looks like the southern portion of the or the lower portion of the slope still has some movement going on. Uh, the question is, is we need to monitor over that period of time to see whether that’s a continuous or, or what the, what the status is. 00:41:53,800 And then, uh, BGC would look at, you know, what recommendations might be to mitigate that, you know, maybe it just is a continuous monitoring from here until whenever. So but I will, I will get that Like I said, right now it’s, we just talked the last couple of days about scheduling that meeting. So, OK. All right. 00:42:16,730 Anything else on Apple Creek? Yeah, we can move on to other old business this morning. I know Mitch, is there any update from Burleigh County on the CRS this month or kind of where things sit with. on your end Where do you Mitch? Morcom Commissioners. 00:42:36,070 Uh, yeah, I had a, a Zoom meeting yesterday with uh Matt Lafferty and uh Tom Bernie. Um, about the calf, uh, they, they sent me a spreadsheet of some of the properties they’re having problems with. Um, one of, one of the, uh, uh, projects is the one on Apple Creek, the barn that’s built in the floodway. 00:42:53,730 That is, we received the plaque for that, the plat application for that. So, that’s the first step, um, we should I mean that it’s a very simple lats, 5 acre. a lot and once that’s approved, then we can issue the building permit, you can begin this construction. 00:43:13,630 So, probably by this summer, hopefully by the end of the summer, we’ll have that one fixed, but, uh, we have another cab visit in person in February with Matt and Tom, and again, probably in April. OK. So, best guess if we, it’s 2026 a possibility to get up to seeRs done. 00:43:34,330 Well, if we can get through the, the, the spreadsheet that he sent. OK. Yeah, they, uh, there’s a number of, of issues on some of the properties and um but you know, just go through it also I’ll ask you while you’re up for any updates on the ETA. Is that all? Where does that sit right now? Is that Well, yeah, that, um, is going to become effective March 1st. 00:43:55,100 OK. Um OK. The last count that’s close to 1800 properties that are going and that are in the floodplain that would be under our jurisdiction. OK right 1800 buildings, sorry. Yeah. And we haven’t count the parcels yet. OK. All right. Any other questions for Mitch? OK. Thank you. Thank you. 00:44:22,270 OK, I don’t know if Michael’s, if there’s any updates or I know, uh, Jerry on the, on the Garrison Conservancy District. Burley County. Thank you, thank you, Mr. Chair. 00:44:43,100 Uh, there’s gonna be a, we, we applied for to be removed from the, the membership list of, uh, the Garrison diversion, and that is moving along, uh, the, the district is going to have a public meeting, public hearing. One of these data they have not set a date on that, but I think that’s going to be very important. 00:44:59,630 uh, for, uh, not only this group but anybody involved with, with, uh, water to be there and, and testify that we do not, I, I voted against it. I didn’t. It was 3 to 2, so it wasn’t, uh, unanimous or anything like that, but I think that’s a, that’s an opportunity for, for everybody to avoid doing that, avoid uh um retiring from that group. 00:45:21,530 Um, I, the Comm kept comparing money that we were putting in as, as far as the annual membership, 700,000, and the money that they’re getting back and most of that so far that we’ve gotten back has been grants through the Bismarck Park District. They’ve applied for every grant that, that, that has been, been given. 00:45:43,530 But I’m hanging my hat more on, uh, uh, the extra stuff that the birdie, that the district does for lobbying in, in DC lobbying on the state, uh, because we don’t have anybody that does that. The county doesn’t. Uh, so I think that’s very important. 00:46:01,270 Um, I, I don’t know, I, I, I don’t want to make a, uh, prediction on what’s going to happen, but, uh, the board, I certainly will turn down our our application to, to, uh, I think from what I’ve heard, uh, to get out of that group and then uh then we’lle, we will probably appeal it 3 to 2 to go to the state district court and see what happens there. So. OK. 00:46:21,000 That’s never been done, I don’t think so. It’s kind of a new territory for all of us, but, uh, I think it’s very important for our, our group here to, to um whether Michael’s gonna be there to make uh to make uh a presentation for, uh, Bernie County Water Resource District or not, but I think it’s 00:46:38,700 important that we do something, uh, where we can’t if we sit back and do nothing, uh, it’s it’ll influence that group one way or the other, so. OK. Thank you, Comm. Yeah, certainly let us know whenever that gets scheduled. I’m sure we’ll find out in other avenues as well. 00:46:51,900 Once they set that public hearing, then we’ll go from there. OK. Circle back. OK. OK. Thank you, Comm. Any questions? OK, thank you OK, uh, moving on to, I know MRCC, is there any updates this morning on, on that one? No, Mr. Chair. 00:47:11,000 Um, Travis has been in touch with him and probably touched base with him again. It sounded like it was a preliminary idea and approach and um. until it actually goes forward, until we see plan sets, there’s really no additional response, so OK. We’ll just touch base with them and see what their status is. OK. 00:47:25,630 I mean, uh, as we look closer at what they wanted to do and where our structure was located. I don’t think there’d be much of an impact anyway, right, yeah, but it’s nice to see the final plans and especially related to the, uh, uh, the drainage features along the edge of the toe of the 00:47:40,370 levee. Yeah, that’s the, that’s the real impact of what may be, might be there. Yeah, OK Thank you. Yep All right, move on to new business this morning. Uh, first item there, the meeting dates. 00:47:57,470 So the one we’re is, is, is next month that we’re looking at is we had it listed as February 18th, but due to some other commitments, uh, we’re looking to maybe move that to February 4th. So hopefully that works for, I think I’ve kind of talked with most of you, that that would be it. OK? and Wendy’s already checked on the room and the room is available, so. 00:48:12,870 we’ll move the February meeting to uh, Wednesday, February 4th at 8:00 a.m. in this room, so the rest of them I think are presented as is and a couple of them we did move was November and December. November for Veterans Day and December because of the water conference, so. 00:48:34,730 so those will get posted on our website OK? Um, next item. in your packet, there’s, uh, we did get a uh USGS reached out to us to sign the agreement for 2026. uh for the uh gauging station, so. 00:48:58,730 we go and went ahead and signed that, and we’ll send that back to USGS just to kind of more information and purposes for in your packet here Do we have to vote on that Um, that’s a good point, cause I know we talked about it last fall, but yeah, we can, you, we can certainly have a motion today too, just to kind of. close it out So it. Yeah, no, that’s fine. 00:49:18,170 So, yeah, we got entertain a motion to uh go ahead and sign that agreement and make the payments to USGS for that gauge. Uh, bowel move that we, Proceed that way. Second. Got a motion by Man Smith and a second by Man Mitchell to go ahead and sign the USGS joint funding agreement for the Apple Creek stream gauge. All those in favor say aye. Aye. 00:49:43,630 Oppose Ayes have it motion passes OK, and then additional information to packet there on page 40 is for that, uh, anne use, uh, the annual water use survey from the Department of Water Resources, as Michael said that he’ll work through and get that filled out and sent in. That’s correct. We’ll get that taken care of, OK? All right. 00:50:07,600 One Oh, Casey Good morning. Morning. Just, uh, one or two informational items, uh, the Apple Creek Bridge on Apple Creek Road, approximately half a mile east of 80th Street Southeast. is going to be reconstructed this year. So the bid is February 27th. 00:50:33,330 We’ll have detours in place, uh, the bridge will be removed, we’ll put in triple box culverts will be replaced. We do look at a bridge, but the, uh, quite the aquifer underneath. We were having water shooting out 2 2 ft above the ground. Oh, no. And, uh, we, it was going to compromise all the piling on that one, so we had to, had to change direction on that one. 00:50:49,330 But we’re not, we don’t have the contractor yet, so we don’t know the exact schedule. I can just keep you up to date, but if people are asking that, that is what’s going on and we will, uh, update the stream gauge that’s, that’s there. That was East 80th Street. East. About half a mile. Yeah. 00:51:08,470 Then another one that we’re looking at, uh, another Apple Creek Bridge is on Lincoln Road West of Lincoln when you’re going out to the airport. Uh, we received notification from the state that we received flex funds to replace that bridge, but we need to go through the process. 00:51:25,600 Uh, we have to present everything to the board to see if they’re willing to move forward with that, uh, and be able to go from there, uh, because it’s flex funds we’re looking at, uh, we went this year just with permitting wouldn’t be possible, but we are, it would be looking at, 00:51:42,330 try and bid as soon as possible to get it ready for the year after, on there, but, uh, we just got to go through our formal process and see how the if how the board wants to be able to move forward on that. OK. 00:51:57,100 But it was just, let you guys know kind of what’s going on as people start asking questions. Uh, that way you’re at least know, know where you can tell him to call us and go over it with them, so OK. Neither of these structures, we don’t have any gauging or anything, it’s a different bridge, I think that they’re on, right? Uh, Lincoln Road doesn’t have a gauge. 00:52:15,270 The one on Apple Creek Road does. OK. On there, so we’ll have to get that. OK. And that’s part of the plans. Yeah. Is to have that replaced. I’ll be able to go through that. Uh, we did, uh, Ruth Coleman, we did get, I think everything worked out. We had about a 4. 00:52:32,370 5 hour meeting with her. She did sign all the land to sell. We bought that from her, so then we’ll just work with her through. through construction, she still is concerned about her land eroding and that structure that’s there, but I, I don’t think that part’ll go away, but the bridge being replaced. 00:52:54,870 We, we can move forward with that at this time. OK. Uh. A couple things quickly, Casey. The, uh, I did check with, uh, DWR and they never really got back to me relative to that structure. 00:53:14,500 Um, there’s an ongoing discussion relative to the, um, water resource districts who have been given ownership of older dams and older things and, um, I, I’ll update you on that if it impacts this particular issue. But now this is the USGS gauge that will have to be relocated, right? Correct. And you’ve been coordinating with them relative to the relocation. 00:53:30,600 Um, are they gonna have to rerate their gauge, I suspect because of the new structure. OK, as long as that’s being taken care of, it’s just background for me, so. Yeah. Yeah, no, I, we just, we, we got to start over, essentially because we’re setting a new one. Yeah. All right. Appreciate that. Yep. OK. Thank you. Yep. Thank you. Yep. 00:53:48,100 OK. Uh, no other new business this morning. We can move on to item 14. There is additional information of Platts, the stormwater management plans that can be va uh made available to you upon request. Uh, there is one, plat that’s a preliminary, and that we, that we got, uh, notice on, which is the Coomer Rach subdivision. 00:54:06,330 So if you have any interest in that one, certainly reach out to Wendy and she can get the additional information to you. and we can move on to item 15, approval of this month’s bills, Manjereep. Department board members at 43 of the summary of the bills. 00:54:23,470 Um, I did go through them, the, the math is good, um, just one item of note is that the Houston Engineering. invoices I believe represent uh 2 months plus. 00:54:41,730 for many of them, so um, just didn’t take note of that and with that I’d move uh for approval on the payment of bills of in the amount of $70,157.57. OK. And a motion by Man Reep Oh, second. And second by Man Smith to approve this month’s bills, the amount of $70,257.57. Excuse me, Mr. Chair, before you do the vote. Yeah. Uh, you will notice your payroll will go in tomorrow to your bank account, not today. 00:55:06,170 We switched it so that we had approval before we sent it to them. Makes sense, yeah. Thank you. So you will be getting paid the day after the meetings. OK. That works, that works. 00:55:23,270 Any other discussion or questions on the bills? I did notice, uh, also this month Dennis, we didn’t have one from viz Bismarck Parksson Reck, right? So that was kind of. there would probably be a December’s usually comes late in January. Yeah. So we’ll probably have a double next month then. Yes. OK. Or maybe we don’t get January because it’s February 4th. That’s true. We probably won’t. We may not think it’s December. Right. 00:55:42,900 OK. No other discussion. When do you take Roll call vote, please. And. Yes. Managed Re Yes. Manager Smith. Yes. Keviman Landenberger. Yes. Motion passes, bills will be paid. Uh, remaining items in your packet there are just, uh, more details on this month’s bills. 00:56:07,700 Um, like I said, the next meeting will be, uh, scheduled for February 4th in this room at 8:00 a.m. And, uh, maybe we’ll have a, uh another board member. So, um, we are gonna go into executive session, but Jerry, I wanted to mention that Brian is here if you want to meet Brian before he leaves, uh, during, during our executives? Yeah. Yeah. So. 00:56:27,270 um, but yeah, we’re, we’re gonna go ahead and uh move into our executive session now for McDowell Dam.
