Good evening. We’ll call the regularly scheduled Mo and Park District board meeting. uh, to order. Today is January 12, 2026 at 5:30. Uh, at the City Hall, uh, any additions or deletions to the agenda? None. OK. OK, at this at this time, we’ll open up our public communication from visitors. If you’d like to. K, K, can you come up to the mic And please, please state your name and, and address My name is Rick Dentas. I live in 704 8th Avenue. Northwest, Mandan. Welcome, Rick. Hi Uh, I just thought I’d mentioned something that you guys might want to take a look at. That is, uh, with all these electric bikes running around. and they’re using the, the bike path, which is fine. Yeah Using the bike path, uh, is fine, but, uh, you have these guys that want to go 30, 35 miles an hour in those bikes, and you have women walking those paths with uh strollers and and children I don’t really know what you guys are gonna do about it, but, uh, it’s an accident waiting to happen. So that’s really about all I had. OK. Thank you, Rick. I think, I know Cole and I have talked a little bit about this, uh probably a month or so ago, I suppose. President Meske Commissioners along with Mr. Tennis, yeah, we have researched this and by law they are legal class 1 and class 2. Now we all know that they’re doing some retrofitting after they purchased them and they’re definitely hitting high speeds. We’ve had conversations with the city, um, police department in regards how we could enforce this and it’s like everything else, you can’t be everywhere and anywhere, but signage is only as good as people want to read it, unfortunate, uh, but I agree with you, it is an issue that we got to try to figure out a solution because it’s gonna take somebody get in an accident, um, but I had a call today about from a, an elderly couple wanted to get e-bikes and I said, as long as they’re class one class 2, but I can’t tell you the difference between a class 3 or a class 2, just they all look the same to me. What is it just speed and, and OK. All that drives, uh see him all the time down at the golf course on that path there. and always, you’ve got, also got a big boom box hooked up to the back end. That Guy is going over 30 miles an hour. easily. Yeah I’m not making a racial statement or anything, but I’m just identifying the Guy and he’s, uh, he’s heavyweight and he’s black. So, you know, I think, you know, we talked about it a little bit. I know you’ve checked with that, I guess as, as far as, uh, I don’t know how fast Class 1 and class 2s go. They are considered motorizedo. It is an electric, you know, all of them are motorized vehicles, and I know we do have signs stating that have we had any accidents, Cole, that you’re aware of on our Not of that type of vehicle, but again, the e-bikes are considered legal through the federal government because they do have a pedal portion and they have electricist, but we all know that there’s gas power in 100% electric ran bikes. That’s the difficult part is how to police that. I think we Rick, can you come up to the mic, please? Thank you. The one experience I had that was very negative, uh, with them was up at uh Sunrise Park there, Sunset Park, and there’s a one section of that path that it’s got a big curl in it like an S curl. and I’m coming around. I’m walking up the hill. and I could see those guys. They were coming down. There was a man and a woman on those e-bikes. And they, they, there’s an area there where they disappear and they didn’t see me because of the, the configuration of the path. They were unable to see me and I didn’t really notice that he how fast he was going, but that Guy came around that curve, and he didn’t know I was there. He saw me and he just had to lock them up in order not to hit us. That was the only way he didn’t hit us. and uh that’s my experience with it, and it wasn’t good. OK. Thanks, Rick. I know we’ll continue to have talks about it and see where, where we’re at legally and what we can and can’t do, so. All right, seeing no one else in the crowd. I opposed Motion carries OK, item number one, consider for approval of the second and final reading of ordinance 1058 to adopt signature threshold for petitions for candidates to the board of Park Commissioners. We had our first reading at the last one, nothing has changed with that ordinance that we’ve, uh, that we reviewed last time. Um I guess if, if everybody’s basically it, it states that it reduces the amount of uh petition signatures to match that of what our city does. uh, due to the legislative session a few years ago, not this last one, I, and in order to be congruent with them and and reduce it not to a percentage but to a number of 125. Is that correct, Cole? Yeah. OK. So, if we don’t have anything, uh, any further considerations or changes to it, uh, if, uh, uh a motion to pass that would put that into effect after the 2nd reading. I would move to approve adopting ordinance 1058 to adopt the same signature requirements of 125, uh, for nominating petitions for candidates to the uh Pork Board Commissioners. There is a deadline to file, I believe now, uh. a deadline to um with your intent to run, State of interest, OK, um so that, that’s something that came out of the last legislative session, I believe, so. Motion carries Uh, moving on to item 2, presentation. of construction costs and timeline for diamonds 11 and 12 with approval to advertise to bid for our uh youth baseball fields as I stated, Mr. Crock said not able to make it. He had a conflict, so he had reached out this afternoon. So I’ll just kind of give a quick overview. As you know, we’re doing diamonds 11 and 12. 2 years ago, we did diamonds 9 and 10. The man in Baseball Club is 100% funding this project. I reached out to them on Friday to make sure that these cost estimates, um, that are estimated at right around $2.4 million with depending on which bid. they go with, um, that they are supportive of that and they have given their written verbal and verbal approval that they do support for this project to move forward. Quick summary as we’ll go to advertise on the 15th of January. um, advertise until February 11th, we would open bids on February 11th at 1 o’clock. and then come before the park board at our March 9th meeting, um, for final approval pending all the reviews of the specs and also baseball club, um, with their agreement. I believe we’ve had the agreement that Attorney Ruff drafted with the baseball clubs sent to them. They have not signed it yet, but they will sign that once we know what this final so that we make in March we will have a duel. We’ll have the agreement to move the bid forward and the agreement um for the funding for payment of that. So we signed the agreement first, probably correct. OK OK, I guess we need a motion for this, uh, project to proceed, uh, thanks to our partner Man and Baseball Club, who’s done a phenomenal job out there. Pale, you want a President Meske and Comm on even years, we are required to demonstrate to the board all of our banking institutions that we use for our deposits as you see them listed Staran, Dakota Community Bank, BNC First International, and Bravera or who we have listed there, so we would just need a motion to support those designated at depositories for the district. There are current ones as well, correct? Yeah. I’ll make a motion to designate as depositories for the district’s public funds, Starion Bank, Dakota Community Banking Trust, BNC First International Bank and Trust and Bevera. Yes, I spoke with the journey Laird on Thursday, and I brought up with him the question of whether they would be willing to since having difficulty finding a mediator. if they would be willing to wave mediation if we can’t get it resolved. He was going to approach that subject with him. He thought they might uh, and then Friday I got a call from, we had been having difficulty communicating, uh. former US magistrate Judge Karen Klein does mediation and we spoke on Friday. and she explained the scenario to her and she would be willing to do the mediation if we needed to. She did send me an email later in the day, which I’ve not been able to circulate yet I did forward it to Attorney Laird, however, it’s got her calendar with available dates on it. So he’s aware and he’s agreed that she could be the mediator as well, and I will circulate that so you can look for available dates on that as well. OK. And so you, you had mentioned, I think one time the complexity of ADA has been difficult to get that mediator that that’s part of the contract and the complexity of the all the ADA requirements. It’s not, it’s not a, you know, normal mediation for a personal injury case or a simple breach of contract or domestic divorce situation. It’s more complex than that. So, uh, several that I talked with, they shied away from because they didn’t want to have to delve into all of that. OK. OK Thank you I’ve got nothing.
