Um, there’s 1700 miles of road ditch in Burleigh County. 00:36:38,730 Of these 1700 miles, the county highway department identified 39 with significant damage. This is only 2% of the county ditches. But it’s this 2% that is 99% of the problems for this county. Safety, liability, nuisance, damage, everything is amplified in these urban residential areas around Bismarck. 00:37:05,900 This commission discussed at the last meeting about being able to prohibit the use in the area only, or does it have to be all or none? We were told all or none with no explanation. Turned on again. So Burleigh County is already prohibiting OHV from using shared use paths along 43rd Avenue from Centennial to Roosevelt and along South Washington to Sibley Park. 00:38:00,370 These are new, very nice paths placed directly in county right of way. Posted with signs stating no motor vehicles. The county is prohibiting OHV from traveling across this 8 to 10 foot path wide. That’s in a county right of way under county jurisdiction today. 00:38:27,870 How can we do that? If if you’re saying this is legal, you’re now telling me that the county can place a paved strip in the ditch and prohibit OHV access, but a private person who places a private driveway into their property can’t restrict OHV access across it. 00:38:50,270 You heard of the constant repairs and and expense that’s endured by these property owners, who are constantly fixing their private driveway. But now the county can place this in their right of way and actually not allow any motorized vehicles to use these paths. Furthermore. 00:39:22,530 I find it personally suspicious that when we went down this path of creating an ordinance, this is what’s in that packet today, when we talk about right of look at that very last sentence that’s highlighted in pink and includes approaches or driveways into private property. 00:39:41,900 I haven’t seen that definition specifically called out in state law or other laws or rules, but somehow out of all the language, that’s the part that made it into our ordinance. Which to me, that just seems kind of suspicious. All right, so now we’re placing these paths. So let’s say we can now ban OHV on these paths, but yet they’re placed in the county right of way. 00:40:08,070 So we’re now putting them smack in the middle of off road vehicle traffic operating in county right away. So basically that area between that road this is on southwest to Sibley. And that motorized path is for OHV traffic. And the path is adjacent to it. Same with 43rd Avenue. 00:40:33,530 These Ada compliant paths are supposed to be physically separated or have a barrier between them and vehicle traffic, including OHV, is. Think about people walking their dogs or going for a jog that have EarPods in may not realize an OHV is coming up behind them. It’s a disaster waiting to happen. That’s the core of this problem. Until the county shuts down OHV or motorized whatever in these problem spots, commissions for generations to come will still be dealing with this Pennington County Commission, which includes Rapid City, South Dakota, began posting and closing their ditches some 20 years ago.
