Thank you. 00:04:54,430 Chair Schwartz and commissioners, this first regular agenda item for us tonight comes to us from Bold Property Group, LLC, who request approval of a zoning map amendment from the existing R5 residential zoning district to an A plan overlay district or Pod on the new Land Development Code zoning district of R. S residential, suburban, as well as the major subdivision final plat titled Cottage Grove Edition. 00:05:16,900 Uh, the project, as you can see on the screens there, is located in northwest Bismarck, west of North Washington Street, a little ways on the north side of Buckskin Avenue. Uh, if we go to the next slide here, the project area consists of about 2.36 acres and is a re plat of lot A of lot three, block two K estates. 00:05:38,770 The reason this might look a little funky is that we reoriented the, uh, document that was in your staff report as an attachment so that North was facing upwards. So the same direction you would typically see on a map. 00:05:58,100 But this project is currently one parcel, and the applicant intends to use the old or existing major plat process to create a 13 lot in two block subdivision, and the applicant wishes to use this, uh, along with the zoning change to facilitate the development of single family detached homes. 2 or 3 units wide. Sometimes the twos are known as twin homes, of course, as well as one detached single family home on one of the lots as well. 00:06:14,870 Um, adjacent uses to this particular area include single family dwellings to the west, two family dwellings to the north and south, as you can see there, and then to the east. There is one single family dwelling, as well as a little further to the east, a parking lot for a church. 00:06:31,100 Uh, the plot area is identified as urban neighborhood. In the future land use plan, which are generally described as places for quiet enjoyment of home life. So a little more backstory on the zoning portion, specifically on this. 00:06:50,670 Uh, you considered this project the preliminary plat and the zoning change back on February 25th, 2026, and called for a public hearing on the plat and zoning change where the applicant was originally requesting a planned unit development or d. Well, clearly between February and now, some time has passed. 00:07:09,730 And in that in between, the city adopted the new zoning code in May of 2026 so that new zoning code would call this area R. S the whole area. That would call it as SES. Uh, the standard R. S zoning district. And that district would facilitate most of what the applicant wants to do. 00:07:28,230 Um, this particular district would fit the SES, would fit the number of units, the style of units, the setbacks, all of that. But the one aspect of the standard R. S zoning district that the proposed development would not fit into is lot coverage of buildings. The SES would typically permit a 40% lot coverage, the same as the existing R ten zoning district in other parts of town. 00:07:46,900 Um, but this particular development proposes a higher lot coverage for some of those units. So the applicant is now utilizing the new plan overlay district, which is the rough equivalent of a PUD in the new code, where rather than using a PUD to customize everything, the pod says, we’re going to keep 00:08:06,870 everything the same X on on the base district, except for something that might need to be adjusted. So in this particular case, everything is staying the same as the regular SES district, except those lot coverage standards will be adjusted upward in the request. 00:08:25,500 Functionally speaking, nothing the applicant is proposing, uh, from their original plan to now has changed. This is just a procedural change for how staff will handle these moving forward. 00:08:42,970 The the new LDC in this pod process it gets the same thing done, but it’s a little more streamlined and is a little easier to amend in the future if amendments need to happen. So, uh, in this particular case, the development, uh, has an approved stormwater management plan, and therefore that is why staff is comfortable using the Pod process to permit that higher lot coverage, in the same way that we would be comfortable recommending approval of a p ud in prior years. 00:09:01,770 So the public was identified notified of this request via our standard notification process. Publications in the Bismarck Tribune on August 6th and 13th, uh 67 postcards were mailed to owners of nearby properties. It used to be dry all the time. It has turned out into swamp. Every time there’s a rain, there’s all this slop comes through. In the past we’d have. It runs through for 3 to 4 days, soaking my area. I can’t even put in a fence post and tamp it properly because that’s such such water in that ground. And this is the area where the detention pond is going in. Right here. This is, uh. 00:16:02,870 Buckskin out here going east and all of the water. This is in accordance with the stormwater plan. All of the water from the lots drain onto or onto the new street. And each house on both sides drain out and everything runs into the pond. And from the pond and discharges into the. 00:16:29,070 Buckskin Ditch, which will take it out to Washington Street. When buckskin is improved, they’ll be running a storm sewer system, and they’ll be putting in catch basins to pick up the water. Coming out of this project, there’s there’s a a small area. 00:16:52,970 The majority of the water on the lot drains to the north east. At present, we’re changing the drainage to bring it in. There’s a little bit on the back side on this side that drains to the adjacent property, but everything else from all of the units drain onto the street and discharge into the pond, which discharges into the ditch section. So any questions, commissioners. Questions. Commissioner Schell. 00:17:22,400 Maybe I’ll just address one piece of this. We in our ordinances, we don’t have a volume control for stormwater. So as we get more impervious area, obviously that concrete, that driveway, that asphalt road, that asphalt shingles won’t allow as much water to drain or to to be absorbed into 00:17:40,670 the ground. So our, our control mechanism is always on rate. So we want to make sure that we’re not impacting downstream a pipe that can’t handle the amount or the, the speed at the water is coming through the rate. But we don’t have controls in place for volume. 00:17:55,130 So we allow we recognize there’s going to be more volume runoff through here. So the gentleman that spoke earlier recognized that that additional volume is a real thing. 00:18:08,530 And if there is a pond similar to the the other one that’s already in this area, it will take time for that pond to drain out, which means that that water that some of those downstream areas may be, you know, wet for longer. But that’s kind of the trade off that we have. And so I understand your concern, sir. 00:18:21,630 And as part of the urbanization of Buckskin Avenue and in the future, um, as Harvey mentioned, we would look to bring storm sewer up to this area so that we can just discharge that down to Washington Street and not have it leave any of the public rights of ways in the future. But in the interim, there will be a rate control in place. But the volume control really isn’t a concept that we have in our ordinance currently. 00:18:36,600 Thank you. Commissioner Schell. Because I know buckskin is designed to go down considerably when that’s redone, I know in front of my property right now, the manholes are 41in below the dirt below that, because eventually, from the beginning of their development to Washington will be a straight line. Right now, there’s a hill. So I guess is this part of this development? Sure. 00:19:27,430 I can I can take a stab at that. Uh, when the city puts infrastructure in, whether it’s a water main or a sewer main, we try to establish a future grade of what we believe that road will have. So a preliminary grade for Buckskin Avenue has been developed. 00:19:43,300 And as areas, um, develop or approaches are connected to the road, we try to take that into account. Ultimately, the final grade of Buckskin Avenue won’t be known until that project is initialized and kicked off and designed fully and ultimately constructed. 00:19:58,500 But we have plans where we’d like to see those roadways, and then we we try to follow those plans as well as we can. This particular project won’t trigger the reconstruction of buckskin. That would be a separate activity that the city would propose at some future date. Buckskin Avenue was or is on the, um, voter approved list project list from the June election to that can be used to have the half cent sales tax that’s used for roadway construction and reconstruction. 00:20:35,270 Um, I guess buckskin would be eligible to use some of those funding. So this is a project that is probably more shorter term than longer term based on project needs and the issues that are on buckskin, Arabian, Colt, all of those roadways, they are a higher priority for the city to look into doing something. 00:20:49,170 And it wouldn’t be all special assessments. It would be majority of it through sales tax dollars from the entire community. All right. Well, I know I originally when everything to the west of us was developed, we had to pay to pave that road once. 00:21:10,370 Then the year before Washington was redone, they milled that up and they did all the underground, obviously, because they had to have that done before they could do Washington, because it all ties in. Well, now I’m looking at paying for this road to get paved a third time. So it’s starting to get to be a substantial amount of money. You know. 00:21:27,100 So anyhow, that’s why I kind of need to know some of these things too. And yes, as far as the water that we’re there draining, it is exactly the exact place as the other one comes out, which is going to really exasperate the decline of my property. Just I mean, I realized the worst. 00:21:46,230 It was the drainage wasn’t bad, but when they did the development on the other end, they pushed a lot of slop through the culverts. So now it even holds the water up from running out even more than it did. So just I guess I’m bellyaching about that, but it is what it is. But thanks for your information, Robert. Sure. Commissioners. 00:24:31,570 Commissioner Johnson, when North Washington Street was reconstructed, certain assumptions were made for each of the parcels at whatever the zoning was at the time. And then pipes stubbed out of Washington Street that really aren’t being used right now, with adequate capacity for for the developments that would occur. 00:24:45,500 What we’re finding now is, as these lots come on board, or the subdivision that was referenced on the south side of the road, come on board, and we don’t have the infrastructure to get to them yet. Um, our ability to, to, to bring their system, even if it’s regular zoning, not, not even talking about any excessive lot coverage components, some sort of pond is required. 00:25:01,500 And once that pond is in place, whether or not it’s, uh, 38.5% lot coverage or 39.2% lot coverage, it’s really not going to make a lot of difference in the storm sewer system design. So we have a level of comfort that when that system is designed, we take into account what the decisions have been made. 00:25:20,930 And if there’s a need to maintain some sort of stormwater, uh, pond somewhere in the system, or figure out that that angle, if there is some deficiency or some deficiency in the future that we think might present itself, we would take all of that into account when we finally build buckskin to its final state, which would be sometime in the near future. In addition, uh, you’ll be familiar with this plat and zoning map amendment. Uh, you did approve this, already? Uh, last year. Uh, and its previous form under the old zoning districts. 00:27:47,600 Uh, the way our process works is the, uh, when this plat was approved, we hold the effectiveness of the zoning ordinance until it’s recorded. So in this particular case, it was approved prior to land development code, but it didn’t become effective until after the land development code. So I guess that’s a long way of saying it fell between the cracks. 00:28:02,500 And so we need to do a zoning map amendment now to make sure we’re assigning the new categories to, to these districts. Uh, so the categories of, of SES, um and OS and our Em are really equivalent to what was approved already by your board, by this board. Uh, the, the REM district. You’ll recall I had some conditions on it. There was some discussion during the public hearing. 00:28:22,430 Uh, the developer and neighbors all agreed on putting some conditions in terms of the height and the density of that multi-family lot. Uh, so those have been reflected in the pod that’s shown in your staff report. As I mentioned earlier, it’s very similar in nature to what we were doing before. 00:28:38,830 It’s just a different way of organizing these and making them available, uh, for the public and tracking them. So, uh, that’s, that’s the intent of that. The, um, we did follow our standard notification procedures for this. The project area contains 3. 00:32:22,530 20 acres and is located in east central Bismarck, north of East Main Avenue in the northwest quadrant of the intersection of East Broadway Avenue and North 26th Street. Um, as you all are aware, the Land Development Code was adopted by the City Commission in May, and certain standards for residential, residential, manufactured home parks were reduced in an effort to bring some of those older 00:32:42,770 manufactured home parks into conformity. Despite those changes, the applicant was not able to meet certain standards with their proposed redevelopment of the site. As such, a plan overlay district was requested to facilitate revitalization of that area while still meeting the general intent of the Land Development Code. 00:33:05,230 Um, those plan overlay districts are the rough equivalent of the plan unit developments in the Land Development Code. They alter certain aspects of that base zoning district. In this case, the R.M.
